Motor Vehicle Settlements
Trucking Accident
$1.6 Million Dollar Settlement. Don Woody represented the surviving wife in a wrongful death action involving a trucking accident. Her husband was driving his rented convertible along Highway 71 when a semi-tractor-flat bed trailer unit was backing across four lanes of the highway. Her husband died instantly as the convertible ran under the trailer unit. The trucking company blamed the Missouri Department of Transportation for inadequate signage alleging the State did not warn travelers on Highway 71 that a side road was temporarily closed due to flooding. The trucking company also blamed her husband for failing to see the tractor trailer unit backing across the highway.
$870,000 Settlement. Don Woody represented a 33-year-old truck driver who ran into another tractor trailer which had turned over an interstate highway in Pennsylvania rear-ending a car. The trucker suffered a number of broken bones and a closed-head injury.
Motor Vehicle Accident
$250,000 Verdict. Benjamin Stringer and David Ansley represented the husband and children of a woman killed in a motor vehicle collision on Highway 13. The accident occurred when a vehicle drove past a stop sign and into the intersection of Highway 13 striking the vehicle of the woman who was traveling on highway 13. Plaintiffs filed suit against the Missouri Highway and Transportation Commission (MHTC) alleging that inadequate visibility and traffic controls on Route CC contributed to cause the accident.
After two hours of deliberation the jury returned a verdict in favor of Plaintiffs, awarding $250,000 and writing on the verdict form, "The consensus of the jury is to request that in addition to the Plaintiffs' settlement [sic], the MHTC improve the safety of intersection Route BB/CC and northbound Highway 13 by installing rumbled dash strips and an overhead flashing light."
