When Is Termination Wrongful?
Missouri is referred to as an at-will employment state. This means that employers are typically allowed to fire employees for any reason or for no reason at all. However, there are important exceptions to the at-will employment doctrine. One of these exceptions is that an employer cannot discharge an employee if the termination is in violation of public policy. Typically these claims arise when an employee: 1) refuses to engage in an illegal activity; 2) blows the whistle on illegal activity; or 3) exercises his or her workers' compensation rights.
An employee cannot bring a wrongful termination claim simply because he or she was terminated. There has to be evidence or some indication that the firing was wrongful because it violated a law.
