“Economic damages” (e.g. medical bills, lost wages) in medical negligence cases are not capped. “Noneconomic damages” (e.g. pain and suffering, emotional distress, lost enjoyment of life) are capped at $350,000.00 if the medical negligence causes the patient’s death, but are not capped if the patient survives.
