What can I do if my workers' comp claim is denied?

You might already be aware that if you are hurt while on the job or while performing work-sanctioned and related duties in Missouri, you are eligible for workers' compensation benefits. However, what you might not know is your claim could end up getting denied. 

Eligibility does not mean your benefits are guaranteed. You must submit a claim and complete all requirements before approval is possible. If your claim ends up denied, there are options for you to consider in order for you to start receiving benefits. 

The first step is for you to learn the denial reason for your workers' compensation benefits. According to FindLaw, common reasons for the denial of workers' compensation benefits include missing reporting and filing deadlines, not following through with medical treatments, lack of supporting evidence and employer and insurer disputes. 

Depending on your circumstances, you could contact the insurer or your employer to learn what steps you can take to resolve the issue. You might just need to provide missing documentation. However, if your denial is the result of a gregarious error or something you cannot rectify on your own, you might need to schedule a hearing with the Workers' Compensation Appeals Board or work with an attorney who can handle the appeals process for you. 

Many people find the workers' compensation appeals process quite challenging to navigate through on their own. It is often beneficial for claimants to discuss their situations with an attorney to learn options that can help them get a better outcome.
